By the present Application, the Applicant seeks condonation of delay of 379 days in instituting the Appeal challenging the judgment of the Court of Sessions under which the Applicant has been convicted under Section 29 read with Section 22(c) and Section 8(c) of the NDPS Act and sentenced to suffer RI for 10 years and fine.

Perused the Application. Ground Nos.2(a) and 2(b) project AJN

2/2 13 IA-1399.20.odt the difficulties faced by the Applicant on account of National Lockdown and it is during this period that the limitation got expired and, therefore, the delay which had occasioned in filing the Appeal is sought to be condoned.

The reasons cited being bona fide and justicable one, the Application is allowed by condoning the delay of 379 days in filing the appeal.
