This is an application through Jail. The applicant herein is seeking enlargement on bail in Special Case No. 4 of 2014. This Court had requested learned counsel Mr. Sachin Deokar to espouse the cause of the applicant. Mr. Deokar has graciously assisted the Court. Learned APP, upon instructions, submits that the trial has commenced and the prosecution has examined three witnesses. Learned counsel Mr. Deokar upon perusing the record submits that in all there are 42 witnesses and it would not be appropriate to consider the application for enlargement on bail in the midst of the
Dusane 2/2 2 ba 1389.2017 trial. In view of this, the application stands rejected. However, the Special Court (MCOCA) is hereby requested to make every endeavour to conclude recording of evidence as far as possible within one year from today.
The professional fees to Mr. Deokar shall be paid as per rules.
In view of the order passed in Criminal Bail Application No.1389 of 2017, no orders would be necessary in Criminal Application No. 602 of 2017.
