The Applicant has sought relaxation of condition (c) incorporated in the order dated 03/03/2023 passed by this Court in Criminal Application No.28 of 2023. The order was passed granting bail to the Applicant in connection with C.R.No.1127 of 2021 registered with Kasturba Marg police station, under sections 465, 467, 468, 471 and 420 r/w. 34 of the I.P.C. 2.

One of the conditions i.e. Condition (c) was that the Applicant had to attend the concerned police station once in a

week on every Sunday between 12.00 noon & 1.00p.m. until conclusion of the trial.

Learned counsel for the Applicant submitted that the trial is going to take a long time. The applicant has abided by the said condition scrupulously. He has deposited Rs.1 lakh as cash bail. He submitted that the condition (c) may be relaxed. He also relied on the attendance book; a copy of which is annexed to this application.

Learned APP submitted that the condition may not be relaxed in its entirety, but he may be directed to report once in a month.

Considering these submissions, in my opinion, stand taken by learned APP is reasonable. The condition cannot be totally relaxed because it was imposed with some purpose. That purpose will be served if the applicant is directed to attend the concerned police station once in a month.

Hence, the following order:

O R D E R

i)The order dated 03/03/2023 passed in Criminal Application No.28 of 2023 is modified and now the Applicant shall attend the concerned police station once in every month i.e. on first Sunday between 12.00 noon to 1.00p.m. until conclusion of the trial.

ii)Rest of the conditions mentioned in the said order are maintained as they are.

iii) With this observation, the application is disposed of.
