Heard the counsel appearing for the applicant and the learned counsel appearing for the respondent. Appeal has been dismissed on the ground of the failure of the applicant to file appeal paper book within the time granted by this Court. For the reasons recorded in paragraph Nos. 3 and 4, a case for restoration is made out. Accordingly, the application is allowed in terms of prayer clauses (a) and (b), subject to the condition that private paper book shall be filed within a period of two months from today. If the paper book is not filed within the stipulated time, the order of dismissal of Appeal shall stand. 1/2
