Heard learned Counsel for the Applicant and learned APP. 2.

Learned Counsel for the Applicant submitted that Applicant has been granted bail by this Court (Coram:M.S.Karnik, J,) by an Order dated 02.03.2023. While allowing the bail application, this Court has imposed condition No.(d) that Applicant shall report to the DRI office at Marine Lines twice a month on every alternate Friday between 11.00 a.m. to 12 noon.

Learned Counsel further submitted that the investigation in the present case is completed and chargesheet has been filed. Applicant has contacted with tuberculosis and is currently under going treatment for the same. At present, Applicant is residing at Palghar which is far away from the DRI office. As her health condition is not proper, Applicant finding it difficult to travel for attending dates of trial at Thane District Court and DRI office. Applicant is ready to mark her attendance to the nearest Police Station to her residence hence requested to allow the Application.

Learned APP submitted that the condition imposed by this Court is proper and no interference is required in it. 5.

Heard both the learned Counsel.

Exhibit-B annexed to the Application shows that Applicant is suffering from Tuberculosis. Applicant is the resident of Palghar. Applicant is ready to report to the nearest police station instead of DRI office at Marine Lines. Applicant find it difficult to attend the Court dates and report to the DRI office. Investigation has been completed and chargesheet has been framed.

In view of the above, I pass following Order:- S.S.Kilaje page 2 of 3

(i) Application is allowed.
