Mr. Nikhil Pakhare, president of respondent No.4 is present in the Court in response to the notice and, tenders letter dated 11th October 2022 requesting this Court to permit him to remove the unauthorized structure, which is the subject matter of this petition within two weeks from today. The said letter is taken on record. Statement made by the president of respondent No.4 is accepted by way of undertaking to this Court. SNS

The Municipal Corporation is directed to depute the sufficient number of staff to supervise the demolition proposed to be carried out by respondent No.4 on site. The learned counsel for the respondent No.2 is directed to depute sufficient number of constables on site at the time of respondent No.4 carrying out the demolition, to obviate any law and order problem. It is made clear that if the offending structure is not demolished on or before 20th October 2022 by respondent No.4, the Municipal Corporation is directed to demolish the offending structure within three days thereafter.

If the demolition is required to be carried out by the Municipal Corporation, the State Government shall provide sufficient number of constables at the site to ensure that the demolition of the offending structure is smoothly carried out without any law and order problem.

Writ petition is disposed off in the aforesaid terms. No order as to costs.
