Mr.Khandeparkar, learned counsel for the appellant on instruction seeks liberty to withdraw this appeal from order unconditionally. Appeal from order is dismissed as withdrawn. In view of withdrawal of the appeal from order, civil application does not survive and is accordingly dismissed. Ad-interim order granted by this court stands vacated.

In view of the fact that the pleadings are complete and the notice of motion is of the year 2014, learned trial judge is directed to dispose of the notice of motion within one year from today including the issue of jurisdiction raised by the defendants under section 9. Both parties have agreed to co-operate with each other and with the learned trial judge in expeditious disposal of the notice of motion. No order as to costs.
