Heard rival submissions on this application for early hearing of the appeal no.688 of 2013. The appeal no.688 of 2013 is preferred by the present applicant-original complainant challenging the judgment and order of the acquittal of the respondent nos.2 and 3 in the matter of offence punishable under section 138 of Negotiable Instruments Act. In the present matter respondent no.3 is a senior citizen of about 68 years age and respondent no.2 is company. At this stage learned counsel for the N.S. Kamble 1/2
39-appa-740-2015 respondent nos.2 and 3 stated that the respondent no.2 Janak Intermediates Ltd is a company which is under liquidation. He further stated that it is for the applicant to take appropriate steps in accordance with law while taking action against a liquidated company. On this, learned counsel for the applicant stated that appropriate course of action is already taken. 2.
After hearing the parties as above and considering the age of respondent no.3 and considering that this is a matter in which challenge is to the acquittal under section 138 of Negotiable Instruments Act, hearing of appeal is expedited matter is fixed for final hearing on 06th August 2015.
