Heard Mr. Gharat, learned Advocate for Applicant and Ms. Dabholkar, learned APP for Respondent - State. 2.

When this Bail Application is filed, one of the ground stated by the Applicant is that the trial is proceeding very slowly and only one of Plaintiff's witnesses is examined by the learned Trial Court and in that view of the matter, the ground of inordinate delay for the trial to complete is pleaded, and therefore, the Applicant sought enlargement on bail.

Today Mr. Gharat, learned Advocate appearing for the Applicant instructed by Mr. Nitin A. Sejpal would submit that witness action is entirely concluded and the matter is now pending for recording of statement of Accused under Section 313 of Code of Criminal Procedure, 1973.

After deliberating with Mr. Gharat and Ms. Dhabolkar, I am of the impression and opinion that if appropriate directions are passed to the learned Trial Court to conclude and decide the trial as expeditiously as possible, ends of justice would be met. 5.

I say this in view of a specific reason as it concerns the antecedents of the accused in the present case. 6.

Mr. Gharat would agree and conceded that if appropriate directions are passed for expeditious trial, the Applicant would have no objection. The stand adopted by Mr. Gharat is appreciated by the Court. In view of the above and without delineating on the merits, the learned Trial Court is directed to conclude the trial as expeditiously as possible and in any event, if possible, within a period of four months from today.

Mr. Gharat would submit that the Advocate appearing for the Applicant would co-operate with the Trial Court and would ensure that unnecessary adjournments are not taken by the Applicant before the Trial Court.

In that view of the matter, learned prosecutor appearing before the Trial Court is also directed to ensure that the directions contained in this order are adhered to and the trial is completed within a time bound period as directed hereinabove.

With the above directions, Criminal Bail Application No.1934 of 2023 stands disposed.
