In view of the praecipe filed by advocate for the appellant stating that, in view of the fact of part surrender of the disputed premises to respondent No.4-Maharashtra State Road Transport Corporation, Mumbai, on 31st August 2016 and to the complete satisfaction of the said authority, the appellant does not want to proceed further with this First Appeal, as nothing survives in the matter.
