The grievance of the petitioner is that she had filed the Election Petition challenging the election of respondent no.2 before the Court of Civil Judge, Senior Division, Kalyan. As the Election Petition was barred by limitation, Misc. Application no. 413 of 2015 has been filed by the petitioner seeking condonation of delay in filing the Election Petition. The said 1/2

10.wp 7550.16.doc application was filed on 23/11/2015. According to the petitioner, inspite of the fact that respondents have been served, the matter is being adjourned from time to time. He submits that the dispute being the election dispute, it has to be decided as early as possible.

Having considered the submissions made by the petitioner and respondent No. 10, we are inclined to dispose of this Petition by directing the concerned Court to consider and decide the petitioner's Misc. Application No. 413 of 2015 in accordance with law as expeditiously as possible preferably within 3 weeks from the date of receipt of copy of this order. Needless to say that this order will be operative only in case all the parties are served before the said Court. Petition is disposed of.
