On instructions Mr Parekh seeks leave to withdraw the Appeal. He however submits that the Appellant, the Defendant in the Trial Court, be granted additional time to deposit the amount of Rs.9,00,000/- ordered by the Trial Court as condition to the grant of leave to defend the Summary Suit. Having regard to this submission, time to make the deposit is extended until 4th September 2017. The Plaintiff is not to take any steps in the suit or against the Defendant until then, but may proceed in the event of default.
