Release of the Applicant is sought on medical ground and particularly, his heart ailments have been highlighted in the AJN

2/2 38 BA-2555.21.odt backdrop of the Covid pandemic. Some medical reports are placed on record.

Learned A.P.P. has tendered a reasoned medical report of the Applicant dated 09/09/2021 at the hands of the Chief Medical Officer, Thane Central Prison, Thane. The said report is taken on record and marked 'X' for identification. After referring to the Ischemic Heart Disease of the Applicant and the treatment, which was made available to him in J.J. Group of Hospitals in the year 2019, it is stated that on 04/08/2021, he was again referred to the same hospital for follow-up. The Cardiologist has prescribed some medicines, which have been highlighted in the medical report. At the end of the report, it is opined that the prisoner's vitals are stable and he is haemodynamically stable.

In the wake of the said report, the Application cannot be entertained at this stage. However, if at all, any medical emergency arises, the Applicant is at liberty to approach this court.
