My attention is invited to the order dated 04/04/2022. Pursuant thereto, the application was filed before the Sessions Court which was withdrawn. Learned counsel for the applicant submits that under some misapprehension, the application was withdrawn. He seeks liberty to file a fresh application before the Sessions Court.

It would be open for the applicant to file an appropriate application before the Sessions Court. The Sessions Court to consider the matter on its own merits. 1/3

My attention is invited to the order dated 21/12/2022 passed in Bail Application No. 3282 of 2022. Learned counsel for the applicant seeks release of the applicant on the ground of parity. It is for the Sessions Court to consider this aspect on merits.

This is an application for bail in respect of C.R.No. I-392 of 2017 dated 27/10/2017 registered with Vashi Police Station for the offence punishable under sections 395, 341, 342, 400, 120(b) of the Indian Penal Code, 1860 and sections 2, 25 of the Arms Act, 1959 and section 135 of the Bombay Police Act.
