This LPA is filed challenging the order dated 2nd April 2009 passed by the learned Single Judge of this Court in Writ Petition No.7455 of 2008. The said petition was filed challenging the remand order dated 5th September 2008 passed by the Additional Commissioner, Pune Division, Pune. Mr. Patil, the learned Counsel for the Appellants does not dispute that during the pendency of this LPA, the Tahsildar has decided reference made under section 5 of the Mamlatdar's Court Act. Mr. Patil fairly concedes that in that view of the matter, this LPA has become infructuous. In view of the statement, LPA is disposed of having rendered infructuous. [Smt. S. S.
