Today, the learned Additional Public Prosecutor has reported that the applicant is already acquitted in Session Case No.41 of 2016 arising out of Crime No.65 of 2015 registered with Foujdar Chawadi Police Station, Solapur. Regular Criminal Case No.1091 of 2015 and Sessions Case No.41 of 2016 came to be registered in pursuant to this offence and the applicant is ultimately acquitted from that offence.
In the instant application, the applicant is contending that on his complaint, Regular Criminal Case No.733 of 2013 is Gaikwad RD 1/2
(20)APPPNo.4792016 registered for the offence punishable under Sections 323 read with Section 34 and under Sections 166 and 218 of the Indian Penal Code and the said case is subjudice before the learned Judicial Magistrate First Class, Court No.3, Solapur. The applicant is praying for direction to the learned Judicial Magistrate First Class, Madha to decide that Criminal Case in time bound manner. Ends of justice would meet if the applicant is directed to make necessary application to the concerned Court and on such application, the concerned Court decides the priority of the case. Therefore, the Order :
ORDER
(i) The application is disposed of with a liberty to the applicant to move appropriate application before the concerned Court.
(ii) If such application is moved, then the concerned Court is directed to decide the said application for conducting time bound hearing within a period of two weeks from the date of receipt of said application.
