This is an application by the respondent/original accused for bail pending hearing of the appeal filed by the State challenging the acquittal of the applicant/original accused.

The learned Advocate appearing for the applicant/original accused submits that the applicant is 60 years of age and his monitory dues are not released because of pending of the appeal. Therefore, the appeal be heard expeditiously. The applicant has undergone the Angioplasty surgery.

This Court is hearing the appeals of under trial prisoners which are pending before this Court since the year 2010. Therefore in view of the directions of the Hon'ble Apex Court in the matter of Hussain & anr. Vs. Union of India 2017 (5) SCC 702, unless and until such appeals are taken up for hearing and disposed of, the instant appeal cannot be heard.

The application is accordingly disposed of with liberty to mention the matter as and when such occasion arises.
