Heard the learned counsel for the petitioner, the learned counsel for Respondent No. 5 and 6 and Mr. Yagnik, the learned APP for State. 2.

The principal prayer in this petition is for writ of habeas corpus to produce Smt. Padma Srinivasan-mother of the petitioner No. 1 to 3 and Respondent No. 5-Mr. Rajan Srinivasan.

Smt. Padma Srinivasan appeared before the Court today. We have interacted with her in chamber. Upon interaction we have found her

2/3 physically fit and mentally alert. She gave rational and coherent answers to the questions we put to her to ascertain her state of mind. Smt. Padma Srinivasan has also tendered a handwritten note attributing the object which allegedly drives the petitioners to file the present petition. We do not think it appropriate to elaborate. However, we take the said note on record and make it part of the petition.

Our interaction with Smt. Padma Srinivasan dispels the contention of the petitioners that she is in illegal or improper custody of Respondent No. 5.

Mr. Galgali, the learned counsel for petitioners fairly submitted that if the Court has found Smt. Padma Srinivasan fit, the petitioners do not wish to further pursue the matter.

Mr. Yagnik, the learned APP, on instructions of the police officer, who is present in the Court, submits that since Smt. Padma Srinivasan is staying alone in the Suraj Heights Cooperative Housing Society, the police are visiting her in pursuance of the standard practice of keeping rapport with the senior citizens staying alone, so as to protect them.

We record the aforesaid statement. In our view nothing further survives for consideration in the petition and, accordingly, the petition stands disposed of.
