The Petitioner/Co-operative Housing Society has sought allotment of a particular plot No.272 i.e. CTS No.5713. The same has been rejected on the ground that the plot is reserved for municipal hospital. Learned Counsel for the Respondent No.2 sanjay_mandawgad

2/2 3caw2290-19 submits that for deciding the application such as the petition, the Maharashtra Housing and Area Development (Disposal of Land) Regulation, 1982, will have to be considered. Under this Regulation the State has laid down various criterion for allotment of plot. We do not find any specific right for the petitioner to insist on a particular plot to be allotted to him. It is always open for the Petitioner like any other to make an application for available plot, to the State Government/Maharashtra Housing and Area Development Authority (MHADA) for allotment of plot and it is for the Authority to decide the application of the Petitioner as per the Government Regulations and the policy.

The Writ Petition is disposed of.
