The learned Counsel for the petitioner prays for withdrawal of the present Writ Petition saying that what is challenged in the present matter as to issuance of process under Section 138 of Negotiable Instruments Act, does not survive in view of return of the complaint filed by the present respondent No.1 against him, with directions to file it before the appropriate Court having territorial jurisdiction. 2.

The Petition is allowed to be withdrawn and accordingly disposed of. Needless to mention that the present petitioner if aggrieved by any such further order on lodging of the complaint before the appropriate Forum, he can take appropriate course of action as advised.
