The Applicant apprehends his arrest in C.R.No.362/2023 registered with Khar Police Station, Mumbai for offences punishable under sections 370(3) r/w. 34 of the Indian Penal Code and sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956.

Heard learned counsel for the Applicant and learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 3.

The Applicant is the co-owner of the premises wherein the spa in the name of Thai Dream Spa is being operated. Police had received information that the business of flesh-trade is going on in the said premises. Hence, the place was raided. The accused no.1 who was 1/3

present at the place, was arrested and has been released on bail. Learned APP fairly concedes that the victim girls have not supported the case of the prosecution. Hence, this is a fit case for grant of pre-arrest bail. Under the circumstances, the Application is allowed on the following terms and conditions :- (a) In the event of arrest of the Applicant in C.R.No.362/2023 registered with Khar Police Station, Mumbai, he shall be released on bail on furnishing bail bonds in the sum of Rs.25,000/- with one or two sureties in the like amount ;

(b) The Applicant shall report to the Investigating Officer for two days i.e., on 19/06/2023 and 20/06/2023 between 11:00 a.m. to 02:00 p.m.

(c) The Applicant shall not interfere with the prosecution witnesses and shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case in any manner ;

(d) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, 2/3

and/or change of residence or mobile details, if any, from time to time.
