These writ petitions challenge orders passed by the Industrial Court at Pune on complaints of unfair labour practice. The impugned orders were passed on applications for interim relief (Exhibit U-2) in each of the complaints. By these applications, the Petitioners herein (original complainants) had required the Respondent Corporation to continue their services till the final disposal of the complaints and not dismiss, discharge or terminate them or appoint new technicians till final disposal of the complaints. 2.
After the matter is heard, learned Counsel for the parties request the Court to dispose of the writ petitions without passing speaking orders. The petitions are, accordingly, disposed of by directing the Respondent Corporation to continue the services of the complainants for a period of six months under the advertisement/s for temporary engagement for six months issued by the Respondent Corporation on 11 Pg 5 of 6
December 2019, in the posts advertised thereunder. The Industrial Court is requested to dispose of the individual complaints of the Petitioners herein within six months from today. It is made clear that no equities shall be claimed by the Petitioners herein for being continued in service as per the present order. It is also made clear that whilst passing this order, this Court has not applied its mind to the merits of the controversy. All rights and contentions of the parties on merits are kept open, to be decided by the Industrial Court in the pending complaints. Both parties shall appear before the Industrial Court and produce an authenticated copy of this order.
