CORAM

P. N. DESHMUKH, J.

DATE :

22nd JULY 2016.

P.C. :

Heard learned counsel for both the sides. This application is filed seeking limited relief of modification of order of this court dated 20th April 2016 whereby applicant on being released on bail is directed to furnish P.R.Bond in the sum of Rs.1 avk 1/3

Lakh with one or two solvent sureties out of which one is directed to be a local surety. Learned counsel for applicant states that this is a common order passed in Crime No.I-399 of 2013 and in Crime No.I-343 of 2012, and as per the order, though applicant could arrange for local surety in one of the crimes, he being resident of Telangana, needs two months time for arranging local surety in the second crime and till then prays that applicant be allowed to furnish cash bail of Rs.1 Lakh. Learned APP opposes the application on the ground that applicant is not resident of Mumbai and is likely to abscond, if released on bail. It is noted that all these aspects are duly considered by this court while granting bail to applicant.

The limited relief sought by applicant is time to furnish local surety in one of the crimes, though he has already arranged for local surety in other crime as aforesaid.

i) Applicant shall be released on bail on his furnishing P.R.Bond in the sum of Rs.1 Lakh with one or two solvent sureties in like amount as ordered earlier, and on his furnishing cash bail of Rs.1 Lakh for the period of one month from today i.e. upto 22nd August 2016. ii) On being released on bail, applicant shall mark attendance with Mira Road Police Station twice a week up to 22nd August 2016.

Application is disposed of as allowed.
