The applicant is seeking anticipatory bail in connection with C.R.No.467/2019 registered with Pimpari Police Station u/sec.376, 498­A, 323, 506, 341 of I.P.C.

The FIR is lodged on 21/03/2019 by wife of the applicant. In her complaint she has made allegations that applicant had threatened her that he would commit her murder if she did not give him divorce. After that incident, the prosecutrix was residing at her matrimonial house. But on the pleading of the applicant she came back to reside Purti Parab

2 1 - ABA No.1223-19.doc with him. Again she was harassed on the demand of Rs.10 Lakhs. The prosecutrix has basically submitted that on 09/03/2019 she was forced to have forcible sexual intercourse. The allegations shows that the intercourse was unnatural and forced. The prosecutrix has further alleged that on one occasion she even consumed medicines to commit suicide.

Considering the allegations in the FIR the offence is very serious and I am therefore not inclined to grant anticipatory bail. Ld. Counsel for the applicant submitted that custodial interrogation is not necessary. However, looking at the gravity of the offence, the relief cannot be granted. Hence, the following order.

ORDER
