After the NBW was executed, the Applicant moved before the Sessions Court in Sessions Case No.227 of 2013 stating that he be released on bail and assured that he shall continue to appear before the Court in the said case regularly. The learned counsel would then urge that execution of NBW is in lieu of absence of the Applicant before the Sessions Judge and once, the undertaking is given, the Applicant's further detention is not warranted.

2/2 The learned APP opposed the application. What could be gathered from the record is, before the NBW was executed against the Applicant, the provisions under Sections 82 and 83 of the Code of Criminal Procedure, 1973 were taken recourse to against the Applicant. Not only this, there appears to be criminal antecedents as during the bail before the Court below, the Applicant has indulged in other NDPS matter. No case for bail is made out. The Application stands rejected.
