Perused the order passed by the learned Single Judge ( Smt. Justice R. P. Sondurbaldota) dated 12th July, 2016; order passed by the Division Bench of this Court (Coram : A. S. Oka & A. K. Menon, JJ.) dated 11th April, 2017 and the order passed by the learned Single Judge (Shri Justice G. S. Patel) dated 16th June, 2017 in Civil 1 / 2

CAT. 4-17 Application No. 1696 of 2017. The Applicant seeks modification of the order passed by the learned Single Judge (Justice G. S. Patel) directing the Applicant herein to pay the remaining amount of costs to the tune of Rs. 3,50,000/- directly to the Respondent. In the present proceedings, we may not deal with the said request. The Applicant may resort to appropriate remedies in that regard. .

As regards the second prayer to grant extension of time for payment of balance of cost amount, we find that in the facts and considering the objection raised by the other side, no case is made out for grant of extension as prayed.

Civil application is accordingly rejected.
