Heard the learned counsel for the applicant and the learned counsel for legal heirs of deceased respondent no.1.
This application is preferred by defendant for bringing legal heirs on record of deceased respondent no.1 Murlidhar Ramchandra Kowli who died on 10.3.2015.
The learned counsel for legal heirs submit that he received instruction to appear in the present Civil Application on behalf of them. He Mohite 1/2
17 caw2274-15 submits that legal heirs have no objection if Civil Application is allowed. Hence, by consent of both the parties, following order is passed:
(A) Civil Application is allowed in terms of prayer clause (a) and (b) which reads thus:
"(a) This Hon'ble Court be pleased to permit the Applicant to amend the Writ Petition as per Schedule Exhibit "b" hereto.
(b) Liberty to make consequential amendment in view of the aforesaid."
(B) Applicant to carry out appropriate amendment within four weeks from today failing which Civil Application shall stand dismissed without referring back to the court.
(C) If amendment is carried out within stipulated time as stated hereinabove, applicant to serve amended copy of Writ Petition on legal heirs'S advocate thereafter immediately.
(D) Advocate for legal heirs waives service on behalf of them.
(E) Civil application stands disposed off accordingly.
