1] Heard Shri. Pasbola, learned counsel for the applicant at length. Apart from parity, grounds on merits are also pressed so as to make out a case for bail.

2] Learned APP has informed that out of total 70 witnesses, 19 witnesses are already examined. 20th witness is under crossexamination which is scheduled on 25/11/2021. 1/2

6.1571.19 BA.doc 3] In the aforesaid background and having regard to criminal antecedents in this State and also in the state of Uttar Pradesh, this Court is not inclined to show any indulgence. 4] However, in alternate, Mr. Pasbola made a request that in case if the trial is not concluded within stipulated as same is expedited by the Apex Court, Applicant be granted liberty to approach afresh. 5] In the aforesaid background, application stands disposed of as withdrawn.
