CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.1691 OF 2016 IN WRIT PETITION NO.2282 OF 2016 Deb Kumar Tapadar Applicant/Petitioner V/s The State Government of Maharasthra ..... Respondent.

---- Mr. Deb Kumar Tapadar, Applicant/Petitioner in person present. Mr. P.G. Sawant, AGP for Respondent/State.

---- CORAM: V. M. KANADE & M.S. KARNIK JJ.

DATE: 15th October, 2016 (In Chamber at 2.45 P.M.) P.C.:

1.

Applicant has filed this application for recalling the order dated 25th April, 2016 passed by this Court. It is submitted that in the said Petition, Applicant/Petitioner had asked for two reliefs; one was for grant of Arms License and the other for compensation of Rs 1 crore. Applicant submitted that so far as the first part of the relief is concerned, this Court has directed the State of Maharashtra to consider the Application of the Applicant/Petitioner. He is therefore not aggrieved by the said direction given by this Court. He, however, submitted that his prayer for compensation of Rs 1 crore was not

2/2 CAW/1691/2016 considered by this Court.

2.

In our view, since we have allowed the main prayer of the Applicant/Petitioner by directing the State of Maharashtra to consider the Petitioner's Application, ancillary prayer of compensation was not granted. It is clarified that no case was made out for grant of compensation of Rs 1 crore. We are therefore not inclined to review our order dated 25th April, 2016. Reserving the right of the Applicant/Petitioner to claim compensation at appropriate stage, Application is disposed of.
