The applicant was arrested on 18th June, 2020 in Crime No. 595 of 2020, registered at Virar Police Station, for the offence punishable under Sections 302, 307 read with 34 of the Indian Penal Code and already charge-sheeted.

The role attributed to the applicant in commission of crime in question is that of holding hand of the victim. 4.

From the statements of the complainant, Victim-Ranjana and eye witness, Manoj, it can be inferred that there is no role of

Dusane 2/2 21 BA 1361.20.doc applicant in commission of crime for the offence under Sections 302 and 307 of Indian Penal Code but for holding hand of the VictimRanjana. 5.

Investigation in the matter is over and charge-sheet is already placed on record.

In the aforesaid background, in my opinion, the applicant deserves to be released on bail. The application is allowed on following terms and conditions :

O R D E R

(i) The applicant be released on bail in Crime No. 595 of 2020, registered at Virar Police Station, for the offence punishable under Sections 302, 307 read with 34 of the Indian Penal Code, on furnishing P.R. bond in the sum of Rs.10,000/- with one or more sureties in the like amount.

(ii) The applicant shall neither influence the prosecution witnesses in any manner nor tamper with the evidence. ( NITIN W. SAMBRE, J. )
