This is an Application under section 439 of Cr.P.C. filed by the aforesaid Applicant who is facing trial in Sessions Case No.709/2019 pending on the file of Sessions Court, Dindoshi for offences punishable under sections 341, 342, 376, 452 and 506 of the Indian Penal Code. 2.

After arguing the matter for some while, Ms. Deepa Devadiga, learned counsel for the Applicant sought leave to withdraw the Application with liberty to file fresh Application after the evidence of the prosecutrix is recorded. Leave with liberty is granted. Bail Application stands dismissed as withdrawn.
