The learned counsel for the applicant seeks permission to withdraw the application with a liberty to file a fresh application before the Sessions Court which may be disposed of within three weeks after filing. In the meanwhile, the learned Special Court (MCOC), Thane, shall proceed with the recording of evidence via video conferencing in M.C.O.C. Special Case No.13 of 2012. Pendency of any bail application either before the Sessions Court or before the this Court shall not be construed as a stay to the recording of evidence and the progress of trial.
