At the outset learned counsel for the appellant submitted that, the draft Notice of Motion has now been numbered and is riped for hearing. He therefore, on instructions, seeks leave to withdraw the present appeal with liberty to pursue the Notice of Motion. Leave and liberty granted.

It is made clear that this Court has not expressed any view on merits of the matter.

Appeal is disposed off as withdrawn.

The trial Court is directed to expedite the hearing of the said Notice of Motion.
