Learned APP submitted that co-accused Ajay Waghmare had preferred an application for bail vide Bail Application No. 1273 of 2018 before this Court. Said application was disposed off on 3rd July, 2018. In the said order, it was observed that after hearing learned counsel for the applicant at length when the Court was not inclined to grant any relief, the application was withdrawn with liberty to file a fresh application for bail before the trial Court, if the trial does not commence within a period of one year. Learned APP submits that charge has been framed on 8th August, 2018. It is submitted that prosecution intends to examine about ten witnesses.

In view of the aforesaid circumstances, learned advocate seeks permission to withdraw this application. However, it is submitted that applicant is in custody from 22nd April, 2017 and in the event trial do not get concluded within six months liberty be granted to prefer for the application for bail. 3.
Application is allowed to be withdrawn.

In case trial is not concluded within six months from the date of receipt of order, applicant would be at liberty to prefer an application for bail before the trial Court.
