The petitioner is a complainant on whose complaint an offence came to be registered vide FIR No. 297 of 2015 dated 26/12/2015 under Sections 376, 406, 495 read with Section 34 of the IPC. The grievance of the petitioner is that the accused is interfering in the investigation. Repeated complaints were made by the complainant in the police station. The Investigating Officer, who was in-charge of the matter did not take appropriate steps to complete the investigation expeditiously. 2.

Learned APP has tendered investigation papers before us,

905-wp-2206-16 which we have perused. It is submitted that a new Investigating Officer - API Rajaram Patade, attached to Govandi Police Station, Mumbai is now in-charge of the matter. The earlier IO, who had handled the case is not incharge of the case now. Learned APP further submits that in respect of the complaint filed against the Intelligence Officer, an N.C. has been registered. Perusal of the record shows that substantial investigation is complete. Learned APP stated that mobile phone has been forwarded to forensic expert for getting report in the month of February, 2016. The police is awaiting the report.

We direct that the Investigating Officer shall obtain report from the expert expeditiously. The further investigation shall be conducted under the supervision of the DCP, Zone - VI, Mumbai. The DCP shall take necessary steps to get the report from the expert. After getting report, we direct the Investigating Officer to file a final report after taking approval from the DCP.

Keeping all issues open, petition is disposed of. 5.

Stand over for three weeks for compliance.
