The Civil Application is moved for condonation of delay of 88 days in filing the Appeal from Order.

Learned Counsel for the applicant/Corporation submitted that the Corporation and its Counsel who was assigned the work, was overburdened and there is a constant flow of cases and has to attend the Court every day. So also, it took time to obtain sanction from various higher authorities and therefore, it is prayed that delay be condoned. 3.

Learned Counsel for the Respondent / the original plaintiff, has opposed this application. He submitted that the reasons given in the application are not sufficient to condone the delay and the respondent/plaintiff is a poor person.

Considered the submissions of the learned Counsel for the applicant and also considered the reasons given in para 4 of the application. In view of that, the delay of 88 days is condoned. Civil Application is allowed accordingly.
