The only prayer sought in this Petition is that the proceedings in Criminal Case No.489/PW/2005 pending in the Court of learned Additional Chief Metropolitan Magistrate 37th Court, at Esplanade, Mumbai, be expedited. The proceedings are pending since 2005. The proceeding relates to the offences under Sections 454, 457 and 380 of Indian Penal Code.

The Petitioner was also prosecuted in another case registered with Sessions Case No.246 of 2011 for an offence under Section 302 of IPC and he has been convicted and sentenced to suffer imprisonment for life.

From the roznama dated 18/11/2014 and 17/12/2014, it appears that the trial Court is aware that the Petitioner is in custody in Kiran Kawre

Considering the facts that the proceedings are pending since 2005, directions can be given to the trial Court to the expedite the proceedings.

ORDER

i.

The hearing of proceedings arising out of Criminal Case No.489/PW/2005 pending in the Court of learned Additional Chief Metropolitan Magistrate 37th Court, at Esplanade, Mumbai is expedited. ii.

The trial Court is requested to make an endeavor to conclude the proceeding within a period of six month.

Iii.

The Petition stand disposed off.
