1] This is an application for modification and/or cancellation of Condition No.2 imposed upon the applicant by an order dated 24th April 2015 passed in Criminal Bail Application No.248 of 2015. By the said condition, the applicant was directed to report to the concerned police station on every Sunday between 10.00 a.m. and 12.00 noon till the conclusion of trial and shall not leave Mumbai without permission of the trial court.
2] Learned Counsel for the applicant submitted that since the
date of his release from jail, the applicant is regularly and without fail attending the concerned police station on every Sunday. He further submitted that the applicant has not committed a single default till date. In the circumstances, he prayed that the said condition may be modified and the applicant be permitted to attend the concerned police station on first Sunday of every month. The learned APP on the other hand submitted that appropriate orders may be passed in the interest of justice.
3] After taking into consideration the fact that the applicant has regularly attended the concerned police station since his release as per the condition prescribed by this Court, I am inclined to allow the present application by directing the applicant to attend the concerned police station on first Sunday of every month between 10.00 a.m. and 12.00 noon till the conclusion of trial. Hence, the following order:- (i) The condition No.2 in order dated 24th February 2015 is hereby modified to the extent that hereinafter the applicant shall report to the concerned police station on first Sunday of every month
between 10.00 a.m. and 12.00 noon till the conclusion of trial. (ii) Other conditions imposed upon the applicant by order dated 24th February 2015 are not disturbed;
(iii) The application is allowed in the aforesaid terms. (A.S.GADKARI, J)
