This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 1041 of 2021 registered at Shikrapur Police Station, Pune for the offence punishable under Section 302 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, there was a dispute between the deceased and the co-accused Abhijeet Parhad. According to the Kanchan P Dhuri 1 / 2

907-BA-1974-2022.odt prosecution, on the day of incident, which took place on 21 December 2021, the present applicant and other co-accused assaulted the deceased by iron rod and committed his murder.

I have perused the statement of eye-witnesses. The alleged assault by iron rod is attributed to the co-accused Abhijeet Parhad. Prima facie, the incident does not appear to be premeditated. Considering these facts, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Ramchandra Abhimanau Parhad be released on bail in Crime No. 1041 of 2021 registered at Shikrapur Police Station, Pune for the offence punishable under Section 302 r/w. 34 of Indian Penal Code on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.
