Perused the statement of complainant dated 11/12/2017. At this stage we are not in position to hold that the said statement does not contain any material implicating petitioners in the matter. 2.
Learned counsel for the petitioners however submits that names of petitioners Nos.4 and 5 appear at fag end in it and report is also after huge delay. Again at this stage, the said contention cannot be appreciated. The FIR prima facie connects the petitioners with the crime. 3.
We however clarify that our observations are only for the purpose of exercising jurisdiction under section 482 of Cr.P. C. and shall not affect the contentions of the petitioners on merit. This contention can be looked into by the trial court at appropriate juncture. With this direction, we dispose of writ petition.
