The applicant is accused of the offence punishable under Sections 65(a) and 65(3) of the Maharashtra Prohibition Act, 1949, since it is the case of the prosecution that the intoxicant, which was manufactured in the union territory of Dadra and Nagar Haveli and Daman and Diu, has been transported for sale to the State of Maharashtra at the instance of the applicant. Since the offence is punishable with imprisonment, M.M.Salgaonkar

The applicant shall abide by the said notice and report to the Investigating Officer. In case, the Investigating Officer desires to arrest him, he shall follow the procedure prescribed under Section 41A of the Cr.P.C.
