This is an application for anticipatory bail in connection with CR No.I-305/2017 registered with Virar Police Station, Palghar for the offence punishable under section 406 of IPC. 3.

The complainant was lodged by the first informant alleged that the applicant / accused was handed over the gold ornaments for conducting business. The accused closed the shop and his whereabout was not known to the complainant and therefore the FIR was lodged.

Learned advocate for the applicant submits that the applicant had gone out of Mumbai. There was no intention of causing any loss to the complainant. He submitted further that the applicant on his returned back, the gold ornaments were handed over to the complainant. Learned advocate appearing for the complainant does not dispute this fact.

In view of the aforesaid circumstances, the application deserves to be allowed.

Hence, I pass the following order;

:: ORDER ::

(i) In the event of the arrest of the applicant in connection with CR No.I-305/2017 registered with Virar Police Station, Palghar, the applicant may be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only.) one or more sureties in the like amount.

(ii) Application stands disposed of.
