The Petitioner is seeking compassionate appointment in the services of the State of Maharashtra on the ground that the Petitioner's father was a Government Servant. Clearly the Petition ought to have been filed in the Administrative Tribunal. As per the constitutional scheme, the Administrative Tribunal is a court of first instance in respect of the service matters relating to the State. With liberty to the Petitioner to apply the Tribunal, we dispose of the Petition. We have no doubt that if a question of delay arises, the Tribunal will consider the fact that the Petition was pending in this Court.
