Heard learned Counsel for the parties.

This application is for condonation of 97 days delay in filing Second Appeal challenging the decree dated 11.12.2013 passed by the learned District Judge-1, Nashik in Regular Civil Appeal no. 237 of 2005.

The learned counsel for the respondents vehemently opposed the present Civil Application. They submit that applicant has not shown sufficient cause for condonation of 97 days delay in filing Second Appeal.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Civil Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, following order:

a) Delay of 97 days in filing Second Appeal is condoned.

b) Civil application stands disposed off accordingly.
