IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 2567 OF 2018 Ravindra Rohidas Fegde ... Petitioner

Versus

Mohini Hemant Fegade and Anr.

...

Respondents Mr. Rounak Naik for the Petitioner.

Smt. S.D. Shinde, APP for the respondent State. CORAM : B.P. DHARMADHIKAKRI & SARANG V. KOTWAL, JJ.

DATE :

DECEMBER 17, 2018 P.C.:

Heard learned counsel for the petitioner and APP for the respondents.

2.

Learned counsel for the petitioner submits that the registration of FIR is belated because of the influence of police relatives of respondent no. 1. According to him there is only one sentence in the entire report where it is claimed that the petitioner asked the husband of respondent no.1 as to why he has married the village girl.

3.

The report is of 20/7/2016. Admittedly the chargesheet is already filed.

The contention that the police officers are using their influence cannot be said to be valid at this stage. Petitioner can approach the trial court and seek discharge where other material if any also can be looked into. Hence, without observing anything on merits and keeping all the contentions open and with liberty to the petitioner to move for discharge, we dispose of the present proceedings.
