Heard the learned counsel for the appellant as well as the learned APP on behalf of the State. The learned counsel for the appellant's original contention was that the subject matter of dispute i.e. assets belonging to the petitioner were never notified by the Home Department. 7-APPEAL-885-2019.doc Notification dated 16th June 2016 issued by the Home Department under the Maharashtra Protection of Interests of Depositors (in Financial Establishments) Act, 1999, published in the Official Gazette. In view of such fact, the learned counsel for the appellant seeks to proceed with the trial with liberty to withdraw the appeal and with a further liberty to move appropriate proceeding seeking relief in the matter.

Accordingly, the appeal stands disposed off.
