Heard the learned counsel for the parties.

This application is for bringing legal heirs on record of deceased appellant no.1, Dadu Tukaram Patil who died on 9.5.2015.

This application is filed on 3.7.2015 i.e. within time.

The learned counsel for the applicant submits that appellant no.2, Keshav Dadu Patil is legal heir of deceased appellant no.1. Hence, applicant may be permitted to treat appellant no.2 as legal heir of deceased appellant no.1.

Considering the submissions made by the learned counsel for the applicant and the 1/3

averments made in Civil Application, I am satisfied that the applicant has made out a case for allowing Civil Application. Hence, following order is passed:

a) Applicant is permitted to carry out appropriate amendment by showing applicant no.2 as legal heir of applicant no.1.

b) Amendment be carried out within four weeks from today.

c) Civil Application is disposed of accordingly. (K.K.TATED, J.) 2/3
