This is an application received through jail for return of certain articles, which are mentioned on page No.2 of the application. 2.

Heard Ms.Kulkarni, learned Advocate appointed to represent Appellant by the High Court Legal Services Committee, Mumbai and Mr.Hulke, learned A.P.P. for Respondent-State. Perused record. 3.

Learned A.P.P. produced on record a report dated 7th April 2022 duly signed by the Police Officer attached to Shahunagar Police Station, Mumbai, wherein the crime against the Appellant was registered. The said report is addressed to the Public Prosecutor, High Court, Mumbai. The said report is taken on record.

Osk 38-Ia-1939-2021.odt It is stated therein that, as per the record, the articles mentioned by the Appellant on page 2 of the application were not seized/confiscated by the Police and there is no record available to that effect. 4.

Learned Advocate appointed to represent Appellant, after perusing entire chargesheet, submitted that, there is no reference of the said articles mentioned in the arrest panchanama or seizure panchanama effected at the behest of the Appellant.

It thus appears from the record that, the said articles mentioned by the Appellant on page 2 of the application are not in the custody of the concerned Police Station.

The present application is misconceived and is accordingly disposed off.
