This is an appeal filed by the Employees' State Insurance Corporation impugning an order and judgment dated 22nd February 1999 passed by the Metropolitan Magistrate 46/25th Court, Mazgaon, Mumbai, acquitting accused of offence punishable under Section 85(a) of Employees' State Insurance Act, 1948.
At the outset, appellant is unrepresented. Secondly, I went through the records and proceedings with the assistance of the learned APP appearing for the State. I have considered the impugned order and the reasons thereof and also considered the evidence. I do not find any infirmity in the order impugned and I see no reason why it should be interfered with.
In the circumstances, appeal dismissed.
