1] The applicant apprehends arrest in CR No.174 of 2014 registered with Manikpur Police Station, Vasai under Section 120-B, 420, 463, 467, 468, 471 and 474 of the Indian Penal Code.

2] The applicant is a practicing Advocate and Notary appointed by the Government. The applicant is 70 years of age as of today. It is the precise allegation against the applicant that he at the instance of co-accused Amol Karpe notarised one power of attorney allegedly exeucted by Jayant Mhatre. The said power of attorney was executed/notorised by the applicant in the absence of said Mr. Jayant Mhatre. This is the role attributed to the applicant in the present crime.

Dond 2/2 aba.947-2015.sxw 3] The learned APP on instructions submitted that all the necessary and relevant documents have been seized from the applicant. She further on instructions submitted that the custodial interrogation of the applicant is not necessary.

4] In view of the above, the following order:

(i) In the event of arrest of the applicant in CR No.174 of 2014 registered with Manikpur Police Station, Vasai, the applicant shall be released on PR bond of Rs.25,000/- with one or two local solvent sureties. (ii) The applicant shall not tamper with evidence and/or influence the prosecution witnesses.

(iii) The application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
